1 • Preliminary provisions
Unless otherwise stipulated in writing and signed by the parties, these general terms and conditions of service apply in their entirety to any service offer and any service provided on the GUÉDELON site, such as the organisation of visits, educational workshops, catering and related services sold by SAS GUÉDELON (the Seller) to the customer (the Customer) for the purpose of reselling the Services to the Customer’s customers (the End Customers). They constitute the essential and decisive terms and conditions and prevail over any other document issued by the Customer, regardless of its terms, even if it is communicated after the communication of the general terms and conditions of service. The Seller reserves the right to modify the general terms and conditions of service at any time. The fact that the Seller does not invoke any clause of the general terms and conditions of service at a given time shall not be interpreted as a waiver of the right to invoke all the clauses at a later date. If any clause of the general terms and conditions of service is found to be invalid or void for any reason, the other clauses shall remain unaffected and the parties shall negotiate in good faith to amend the invalid clause.
The Customer undertakes to inform End Customers of the terms and conditions of the Services and to obtain their acceptance thereof.
These general terms and conditions apply to all sales transactions concluded by SAS GUÉDELON (ticketing, tours, workshops, catering) with travel professionals or organised groups. Groups are defined as 20 or more paying participants (adults and children combined).
2 • Capacity
All customers of SAS GUÉDELON acknowledge that they have the capacity to enter into a contract under the terms and conditions described in the general terms and conditions of service below, i.e. that they are of legal age and are not under guardianship or trusteeship. All customers of SAS GUÉDELON acknowledge that they have read these general terms and conditions of service before placing their order or making their reservation. Therefore, placing an order or making a reservation implies full acceptance of the general and specific terms and conditions of service of SAS GUÉDELON and unreserved acceptance of all of their provisions.
3 • Ordering admission tickets and services
3.1 Making a reservation for a group visit: reservations can be made:
- by telephone on +33 (0) 3 86 45 66 66 from 9am to 5.30pm, Monday to Friday
- by email at: reservations@guedelon.fr ;
- on the Seller’s website, accessible at https://www.GUÉDELON.fr, for groups of 20 participants or more.
To benefit from the ‘group’ rate when booking, the Customer must place their order at least 15 days before the date of the visit, subject to availability.
When making the reservation, the Customer must specify the date of the visit, the nature of the services, the times of the services, the number of participants, the number of menus or picnic baskets and all their contact details (postal address, telephone number, email address, etc.).
Pre-booking procedure online on the GUÉDELON website www.guedelon.fr using the forms provided. To do this, the Customer chooses the services for a specific date, indicates an approximate number of participants and submits their availability request by emailing the form to the GUÉDELON booking service.
The Seller shall check availability and acknowledge receipt of the booking by sending a booking contract with a file number by email. If the Seller does not have availability, they shall offer the Customer an alternative, but no booking shall be made without the mutual agreement of both parties.
Effect of the booking: all bookings will be effective once the Seller has sent the booking contract with the file number and received the deposit. After the Customer has placed a final order, they may contact the Booking Department by email at the following address: reservations@guedelon.fr, by telephone on 03 86 45 66 66, or by fax on 03 86 45 66 67 to make any changes or additions to the order. A new booking contract will then be drawn up and sent after agreement by both parties.
3.2 Placing orders for tickets for works councils and similar bodies and resellers for individual distribution.
Discounted tickets may be purchased by works councils, local authorities, associations, resellers, etc. for distribution to their employees, agents, members, customers, etc. All orders must include a minimum of 20 tickets, for adults and/or children. These tickets are undated, valid for two years from the date of issue, and allow free entry to GUÉDELON during opening days and hours (please refer to the current opening calendar). Orders can be placed by completing the online form on the GUÉDELON website www.guedelon.fr under the ‘Works Council’ section, or by completing the order form available for download at www.guedelon.fr or on request by calling 03 86 45 66 66. The order form must be returned to us, duly completed and signed, by post to the Seller’s address, accompanied by payment for the total amount of the order. No administration fees or ticket delivery charges are payable for standard delivery. If the Customer wishes to have the tickets sent by registered post or tracked delivery, they will be charged €6 (including VAT) towards the delivery costs. Tickets will be sent by standard post to the Customer upon receipt of full payment for the order. Tickets cannot be returned, exchanged or refunded.
3.3 Placing ticket orders for individuals on the online ticketing service:
Orders are placed via the GUÉDELON website www.guedelon.fr, which redirects the Customer to the online ticketing provider IREC at the following address: billetterie.GUÉDELON.tickeasy.com. The Customer chooses the desired services (admission ticket, guided tour, workshops, etc.). The admission ticket is not dated, is valid for the current season at the date of purchase and can be used on any day that GUÉDELON is open (the Customer should refer to the opening calendar for the current season). Other services (guided tours, workshops, etc.) are subject to the date and time chosen by the Customer at the time of ordering. The Customer places all the desired services in their basket and must fill in the form provided and create a personal account on the website or log in if they already have such an account. The username and password are confidential and for the Customer’s sole use. The Customer is required to check the quantity, date and time of their reservations before proceeding with payment. No refunds can be made after the order payment has been confirmed. Payment can only be made by credit card using a secure payment system. After paying for their order in full, the Customer is invited to download and print their e-tickets. These tickets must be presented at the ticket checkpoint at the main entrance to GUÉDELON on the day of the visit.
4 • Admission tickets and performance tickets
‘Access tickets’ refers to tickets allowing entry to the GUÉDELON site for a self-guided tour.
For group bookings: no admission tickets and/or service tickets will be sent to the Customer in advance. The booking contract sent is valid and must be presented at the ticket office on the day of the visit. Admission tickets and all documents relating to the visit or services will then be handed over in person.
For orders of CE and similar tickets and resellers: admission tickets will be sent free of charge by standard post (unless expressly requested by the Customer – see Article 3) by the Supplier La Poste. GUÉDELON cannot be held responsible for any problems (delays, non-receipt, etc.) relating to the delivery of the order. The order will only be sent after full payment has been received. In the event of loss, theft or damage to the admission tickets, the Customer shall inform the Seller as soon as possible, quoting the ticket numbers concerned, so that the Seller can deactivate the validity of the admission tickets electronically if they have not already been used.
For ticket orders for individuals on the online ticket office: after validation of the total payment, electronic tickets can be downloaded by the Customer in PDF format. These admission tickets and service tickets must be printed and presented at the access control point at the main entrance to GUÉDELON on the day of the visit. The Customer is responsible for checking that the admission tickets and service tickets are printed clearly, particularly the barcode, which must be perfectly legible. Any torn or illegible tickets may be refused at the entrance. If the Customer does not have a printer, they may present the admission tickets and electronic service tickets at the entrance directly on their smartphone or tablet. Only tickets with a barcode will be accepted. The order confirmation does not constitute an admission ticket and will not be accepted.
5 • Prices
The prices of the Services are those indicated in the Seller’s brochures and/or on the Seller’s Website, or, for catering services, on the menu. They are expressed in euros and include VAT. They do not include the Customers’ personal expenses within GUÉDELON. Special pricing conditions for resellers are negotiated in advance with the Seller’s sales department. No special pricing conditions may be taken into account without an agreement between the two parties. When the price is based on the age of the children, the age of the children on the first day of the Services is taken into account. Proof of the children’s age may be requested at any time by the Seller’s staff; if such proof is not provided, the adult price will be applied. Similarly, Customers who are eligible for a reduced price must present proof of eligibility at the ticket office or at the access control point; if they fail to do so, they will be asked to pay the difference between the reduced price and the full price in force.
6 • Payment terms
For group bookings, a deposit of 30% including VAT of the total cost of the services must be paid no later than 30 days after the date on which the booking is made. Without this deposit, GUÉDELON management reserves the right to cancel the booking without notice. In the event of cancellation or modification of the booking, the deposit may be refunded in full or in part if the cancellation or modification conditions are met (see Article 10). The deposit shall be paid by cheque made payable to the Seller or by bank transfer.
Payment of the balance: on the day of the visit, a final invoice will be issued based on the final number of participants and the services provided, in accordance with the conditions mentioned in the section entitled ‘Changes’. The Customer shall check and accept the number of participants and services indicated on this invoice. No refunds may be claimed after the Customer has validated the invoice. Payment of the balance shall be made:
- on site: cash, credit card, bank cheque
- deferred payment no later than 30 days after the date of performance of the services covered by the booking, by bank cheque or bank transfer.
In the event of late payment, penalties will be applied in accordance with Article L-446-1 of the French Commercial Code, and the pre-tax amount of our invoices will be increased by 10% per day of delay as a penalty.
For orders of CE and similar tickets and resellers: the total amount of the order is payable at the time of ordering, by cheque made payable to the Seller or by bank transfer.
For ticket orders for individuals on the online ticket office: the total amount of the order is payable at the time of ordering by credit card only and on a secure payment server.
7 • Resale to End Customers by Resellers ‘End Customers’
Refers to the Customer’s customers (reseller: resale of access tickets to employees, agents, members, etc.). The Customer may transfer access tickets to its end customers free of charge or resell them at a preferential rate of its choice. Under no circumstances may the Customer resell access tickets to End Customers at a price higher than that charged by the Seller for the year in question.
Special cases for tourism resellers such as Tourist Offices, Tourist Information Centres, accommodation providers, etc.: access tickets sold at rates negotiated with the Client may not be resold to the End Customer at a price lower than that charged at the on-site ticket office.
8 • Terms and conditions of services
Group bookings include a date and one or more service times and are only valid for the date and time(s) mentioned. For changes or cancellations, please refer to Article 10. Tickets sold to works councils and similar organisations, resellers and individuals all have an expiry date printed on the back. Performance tickets for individuals purchased online or at the box office are dated and valid only for the date and time indicated. Unless otherwise agreed in advance by the Seller, all tickets and performance tickets will not be taken back, exchanged or refunded in the event of non-compliance with the date and time indicated.
9 • Complaints
Any complaints relating to sales and services must be sent by registered letter with acknowledgement of receipt to the following address: SAS GUÉDELON – D 955 – 89520 TREIGNY, accompanied by all supporting documents, such as admission tickets, service tickets, booking contracts, etc. within 15 days of the services being provided, otherwise they will be deemed inadmissible.
Any incident occurring on the SAS GUÉDELON site that may engage the latter’s liability must be reported to the site’s reception services on the day of the incident.
10 • Changes and cancellations by the customer
Access passes, service tickets and catering vouchers delivered to the Customer or End Customers are non-refundable, non-exchangeable and non-transferable.
Changes: for group bookings: changes in group size must be communicated to the Seller’s booking department no later than 2 working days before the date of the visit (special conditions for catering – see Article 11). Any adjustment, upwards or downwards, will be made at the ticket office on the day of the visit on the final invoice at the current rate. If the change results in an increase in price (increase in the number of participants, purchase of additional services (guided tours, meals, workshops, etc.), the additional amount will be included directly in the Seller’s invoice on the day of the visit. If the request for modification concerns a reduction in the number of customers or the cancellation of one or more of the services ordered, the modification will be considered a cancellation within the meaning of the following paragraph.
Cancellation or no-show by the End Customer on the day of the visit:
For group bookings (adults and/or children):
Due to the customer: cancellations will only be taken into account after receipt of a fax or email and confirmation from the GUÉDELON booking service.
Depending on the cancellation period, the deposit paid will be refunded or retained:
- Cancellation by the customer at least 30 days before the day of the visit: the deposit paid will be refunded in full.
- Cancellation by the customer less than 30 days before the day of the visit: the deposit paid will be retained in full
Due to the seller: Before the date of performance of the services: the seller may at any time delete or modify the services offered in its brochures and on its website. When, prior to the date of performance of the services, the performance of one or all of the services is rendered impossible as a result of an external event beyond the seller’s control (bad weather, storm, inability to access the site, etc.), the seller shall notify the customer as soon as possible and offer to modify the booking by telephone, email or fax. The customer then has the option of: - either request the cancellation of the order without penalty or cost and receive a full refund, by registered letter with acknowledgement of receipt sent to the seller within twenty days of the date initially agreed for the services;
- or accept the modification proposed by the seller. The customer shall inform the seller of their choice in writing as soon as possible.
If, on the day of the customer’s visit to GUÉDELON, one of the services included in the booking cannot be provided by the seller for an unjustified reason other than force majeure, the seller shall, as far as possible, offer the customer another service to replace the service not provided or a refund for the service not provided.
Please note that GUÉDELON reserves the right to cancel the booking and service(s) without notice if the customer does not comply with the terms and conditions of sale (groups of fewer than 20 people, failure to pay the deposit, etc.).
For online ticket orders or orders placed by works councils, resellers, etc.: in the event of cancellation of all or part of the order by the customer, regardless of the reason and regardless of the time frame, the customer shall not be entitled to any refund from the seller.
11 • Special conditions for group catering
11.1 Catering reservations
Reservations can be made by email or telephone. Adult and/or children’s group menus and picnic baskets for groups of children must be reserved at least 15 days before the date of the visit. A general reservation contract (including visits and catering) should preferably be sent by email on the day the reservation is made. A deposit of 40% of the total amount of the booking, including entrance fees, guided tours, workshops, etc. and catering, must be returned to us within the period mentioned on the back of this contract. Without this deposit, the Management reserves the right to cancel your booking.
A catering reservation form will be sent at the time of booking. This form must be completed, signed and returned to us no later than 15 days before the date of the visit. If the catering form is not returned to us within this period, the menu of the day will be served without any possible modifications.
11.2 The composition of menus, dishes, picnic baskets, etc.
In order to offer its customers the best products, favouring local and regional suppliers as well as organic produce, the Management reserves the right to modify the composition of menus or picnic baskets without prior notice, depending on the season, supplies or for any other reason.
11.3 Compliance with reserved dining times
A service time has been agreed between the seller and the customer at the time of booking. The group is requested to arrive 15 minutes before the start of the reserved time at the restaurant ‘Le pain sur la planche’. If a group that has made a reservation for lunch arrives at the restaurant more than half an hour late, service will be provided as far as possible and the customer may be redirected by the vendor’s staff to another restaurant. In this case, if the price at this restaurant is lower than the price at the original restaurant, no refund will be given. In any event, the group’s delay does not entitle them to any refund or compensation.
11.4 Changes to catering numbers:
Any changes to numbers, whether downwards or upwards, must be communicated to the GUÉDELON booking department no later than 7 working days before the date of the visit, either by telephone or by email. If this condition is met and after confirmation by the seller’s booking department, the invoice will be adjusted on the day of the visit according to the group rates in force and the following rules:
Downward change in numbers: any meals not consumed will not be invoiced, up to a limit of 10% of the total number of people booked; if the cancellation concerns more than 10% of the total number of people booked, meals in excess of 10% will be invoiced.
Increase in numbers: additional meals will be provided and invoiced up to a limit of 10% of the initial number of people. For increases of more than 10%, our catering service will do its best to provide these additional meals, but substitute menus may be served.
If the group size falls below 20 people, GUÉDELON management reserves the right to cancel the catering reservation. A catering service for individuals, to be chosen and paid for on site, will then be offered.
11.5 Cancellations: (refer to the general cancellation conditions in Article 10)
12 • Special conditions for online ticket sales on www.guedeon.fr
Orders for tickets and services are subject to these general terms and conditions of sale and the website’s internal regulations.
SAS GUÉDELON uses an external service provider, IREC, for the online sale of tickets and services. SAS GUÉDELON cannot be held responsible for any problems related to connection or navigation.
12.1 To place an order, each customer must first create a secure account with a username and password.
After logging in, the customer will fill in the form with details of the services they wish to purchase. Before finally placing an order, the customer will have the opportunity to check their selection (order) and may modify it as they wish. The order will only be finally placed after the third and final confirmation on the order summary screen.
This final ‘click’ is equivalent to a handwritten signature as referred to in Article 1341 of the Civil Code (hereinafter referred to as ‘the acceptance click’). Once the acceptance click mentioned above has been made, the order is considered irrevocable and can only be challenged in the limited cases set out below. Before this final click, the customer may identify and correct any errors.
12.2 Once the order has been placed, the customer’s computer will be automatically redirected to a page confirming the final validation of the order.
The customer will also receive a confirmation email. Only validation in the form of a printed ticket with a barcode will be valid for access to GUÉDELON. To this end, it must be printed by the customer, who shall use it in accordance with the provisions of Article 2.6 hereof. If the ticket cannot be printed, the customer may present their e-ticket on their smartphone or tablet, provided that the ticket with the barcode is clearly legible. A simple order or payment confirmation does not constitute a ticket for access to the site.
12.3 The customer is guaranteed that their bank account will only be debited once by GUÉDELON via the secure payment site, for the total amount of the tourist product order, once the final registration mentioned in Article 12.2 has been completed.
12.4 All information contained in the confirmation emails shall be deemed to have been accepted by the customer
If they have not contested it by registered letter with acknowledgement of receipt within 8 days. However, they may only be contested if they differ from the reservations.
12.5 By saving and/or printing the confirmation page or email sent by GUÉDELON, the customer has proof of their order, but this document cannot under any circumstances be used as a ticket to access GUÉDELON.
12.6 Tickets to access GUÉDELON can be printed directly by the customer using their own equipment.
12.7 Pursuant to Article L.121-20-4, 2° of the French Consumer Code, the customer does not benefit from the 7-day withdrawal period provided for in Article L.121-20 of the same code.
12.8 – Certain activities indicated in the description on the website may be cancelled, in particular for climatic reasons or in cases of force majeure.
The cancellation of any activity due to force majeure or the behaviour of a third party to the contract shall not, under any circumstances, give rise to any compensation being paid to the customer by GUÉDELON.
12.9 The only method of payment accepted for orders placed via the online ticket office and subject to these general terms and conditions of sale is by credit card (Carte Bleue, Visa and Eurocard/Mastercard are accepted). Payment via the website is made directly to GUÉDELON using the customer’s credit card number via a secure payment system.
12.10 GUÉDELON will issue a summary invoice showing the date and amount of the sums paid by the customer for the tourist product.
12.11 Cancellation and modification
All orders for tickets and/or services purchased on the online ticket office are firm and final. No request for cancellation or modification may be made for any or all of the tourist products. In the event of cancellation by the customer, all sums paid by the customer to GUÉDELON shall remain the property of GUÉDELON, without prejudice to any damages that the latter may claim as a result of the loss suffered due to the cancellation.
In the event of cancellation of the tourist product by GUÉDELON, the customer will be refunded any sums already paid for the tourist product.
12.12 SAS GUÉDELON cannot be held liable under any circumstances, particularly in the event of loss or theft of the ticket. However, a duplicate may be issued at the dedicated ticket office upon presentation of proof of identity, identification and reservation date, provided that the ticket has not been used. The request for a duplicate must be made at least 3 days before the date of the visit, either by email: guedelon@guedelon.fr or by telephone on 03 86 45 66 66.
12.13 In the event that GUÉDELON finds itself unable to fulfil its obligations after the final confirmation of the order, GUÉDELON reserves the right, in order to guarantee as far as possible a product that meets the customer’s expectations, to modify the initial allocation of services, provided that these correspond to the customer’s expectations; where applicable, GUÉDELON shall inform the customer of any changes in a timely manner.
12.14 Personal Account
The customer’s name and password assigned to them when they register to create a personal account are personal and confidential.
However, GUÉDELON may access the offers that the customer selects in their personal account and review them in order to better determine the customer’s expectations and needs. When the customer logs into their personal account, a cookie is placed on their computer to facilitate their use of the account. 13 • Personal data
In accordance with Law No. 78-17 of 6 January 1978 on information technology, files and civil liberties, customers have the right to access, rectify and delete information concerning them, which they may exercise by contacting SAS GUÉDELON, whose registered office is located at GUÉDELON – D 955 – 89520 Treigny, France, which is responsible for processing such data.
This is an individual right that can only be exercised by the person concerned in relation to their own information. For security reasons, GUÉDELON will need to verify the customer’s identity in order to avoid disclosing confidential information about them to anyone other than the customer themselves. This right may be exercised by writing to the seller at the following postal address: GUÉDELON – D 955 – 89520 TREIGNY, specifying the customer’s surname, first name, home address and email address.
Customer data may be transmitted by GUÉDELON to third parties for commercial prospecting purposes, provided that the customer has given their consent on the registration form they have completed.
13.1 The information collected on the Internet Ticket Office is intended for GUÉDELON.
It is subject to computer processing for the purpose of processing customer requests and GUÉDELON’s commercial management, in particular:
- responding to requests for information made on the website,
- placing and managing orders,
- sending commercial information when the customer has given their consent or when authorised by applicable law,

13.2 Fields on registration forms marked with an asterisk must be completed.
If they are not, GUÉDELON will not be able to process the registration request. If the customer does not wish this to happen, they can refer to the ‘cookies’ section of this legal information.
14 • Photos and illustrations
Every effort is made to provide photos and illustrations in brochures, on the website and on the seller’s social media pages to give customers an overview of the products on offer. However, these are not contractually binding and GUÉDELON cannot be held liable for them.
15 • Force majeure
In addition to the circumstances usually considered by French case law to constitute force majeure, the seller’s obligations are automatically suspended, without the seller being held liable for any failure to perform, in the event of force majeure and, in general, in the event of an event beyond its control preventing the normal execution of the order, such as: bad weather, flooding, fire, strikes or lockouts at the seller’s premises or those of its suppliers, supply difficulties, decisions by administrative authorities, riots, vandalism, equipment accidents, transport blockages or delays, force majeure affecting suppliers, or any other cause leading to partial or total unemployment for the seller or its suppliers. The seller shall inform the customer of the occurrence of such an event by post or email, specifying the services concerned. If the force majeure event or its consequences persist for more than 20 days from the date of dispatch of this letter or email, either party may cancel the part of the order that the seller is unable to fulfil, by registered letter with acknowledgement of receipt, without this cancellation giving rise to any compensation, penalty or indemnity.
Visitor guarantee: Guédelon is open to visitors according to a seasonal opening schedule. Customers are responsible for checking the opening schedule for the current season. If certain parts of the Guédelon tourist site are not visible for various reasons, this partial closure will be announced before payment and will not give rise to any refund.
16 • Intellectual property
The seller retains full and complete ownership of its intellectual property rights, particularly with regard to its trademarks and other identifying marks. Provided that the integrity of these marks is fully respected, the customer is authorised, for the sole purpose of reselling the services or promoting the visit to its members, agents, end customers, etc., to reproduce, without modifying them in any way, the trademarks and identification marks belonging to the seller on its promotional documents such as catalogues or advertising brochures. In this case, such materials must be validated in writing by the seller in advance.
17 • Internal regulations
All visitors entering the Guédelon site (car park, construction site, shop, ticket office, etc.) agree to comply with the internal regulations displayed next to the ticket office and ticket inspection area. In the event of non-compliance with the provisions of the internal regulations, staff are authorised to expel any offender without recourse. Customers expelled in this context are not entitled to a refund for any services.
18 • Complaints and Disputes
The general terms and conditions of sale and the execution of orders are governed by French law. Any complaint arising during the performance of the services defined herein must be submitted as soon as possible by the customer, on site and in an appropriate manner, so that GUÉDELON can seek a solution as quickly as possible. In any event, complaints must be sent by the customer to GUÉDELON by registered post within one month of the date of performance of the services. This letter must specify the order or reservation number and the specific reasons for the complaint.
Any dispute concerning the interpretation and/or execution of these terms and conditions that the parties are unable to resolve amicably, or any dispute relating to the services and general terms and conditions of sale, whatever the cause, shall be subject to the exclusive jurisdiction of the courts of Auxerre, including in the event of summary proceedings, orders on application, multiple defendants or the introduction of third parties.
